This Web Site Agreement, hereinafter the "agreement," is between you and FotoRescue (fotorescue.com), operated by Photo Editing Fulfillment, located at 345 S Main St, Alpine, UT. Use of FotoRescue signifies your agreement with all the terms and conditions of the agreement. If you disagree with the agreement’s set forth terms and conditions, do not go any further onto the website.

Conditions of Use:

You agree to read the terms and conditions carefully before using FotoRescue. Continued use of FotoRescue indicates your acceptance of such terms and conditions.

License to Use FotoRescue Website:

FotoRescue grants you a non-exclusive, limited right to use fotorescue.com. Such a right is based on your compliance with all the terms and conditions in the agreement.

By submitting images for digital retouching or hosting, emailing FotoRescue, its employees, or authorized agents, you grant FotoRescue the right to copy, produce, transmit, modify, display, and edit any communication or images received through the use of FotoRescue STRICTLY FOR THE PURPOSES OF COMPLETING YOUR ORDER.

You acknowledge that you UNDERSTAND ALL FEDERAL COPYRIGHT/TRADEMARK LAWS AND THAT ALL IMAGES, MATERIALS, AND/OR COMMUNICATIONS SUBMITTED TO FotoRescue (BY YOU) DO NOT VIOLATE SUCH LAWS. FotoRescue is not obligated to use any communications or images you submit for any purpose.


Information Security:

FotoRescue uses reasonable measures to ensure the protection and privacy of communications, images and billing information submitted to www.FotoRescue.com. FotoRescue uses Secure Socket Layer (SSL) encryption to secure all payment information. You acknowledge that communications and images submitted to FotoRescue are not confidential and may be read or intercepted by unanticipated third parties. You agree that if such interceptions occur, FotoRescue is not liable in any manner under all applicable laws and jurisdictions.

Billing and Shipping:

You agree that all billing/shipping information that you submit is accurate. You agree that you have reviewed and deemed your billing/shipping information accurate. You agree that you have not created multiple accounts to defraud FotoRescue of any promotions or deals or to deceive FotoRescue in any way. You also agree that you will notify FotoRescue upon any billing/shipping information change. You will be held liable for all additional billing or shipping costs that may be incurred due to inaccurate billing/shipping information provided by you. Such costs include but are not limited to additional postage, shipping materials, photo lab fees, collection, and attorney's fees. FotoRescue is not liable for any delay in services or products that result from inaccurate billing/shipping information.

FotoRescue bills upfront at the time of purchase. However, this is subject to change at any time, for any reason, for individual accounts or collectively. FotoRescue may bill for services at any time after the initial order's completion. FotoRescue may attempt to collect payment for services on any payment method that has been created for the same client, independent of having one or multiple accounts.

Refund Policy:

No refunds are available for the FotoRescue services except where required by law.


FotoRescue provides these terms and conditions "as is". FotoRescue maintains the sole right to revise these terms and conditions at any time. FotoRescue reserves the right to terminate such agreement at any time without prior notice to any such user. FotoRescue employees and authorized agents under no circumstances shall be held liable for any damages or any unforeseen damages that may result directly or indirectly from any communications and/or images submitted for personal Non-Commercial and Commercial Uses. FotoRescue shall not be held liable for any communications or images that an unanticipated third party may receive.

Common Sense:

We know the importance of providing our best service and the sensitive nature of working with photographs. These terms and conditions are intended to cover unforeseen problems. We understand the importance of providing quick, professional service, respecting copyright, and communicating well with one another. If you have any problems, comments, or feedback, we expect you to let us know so we can improve and continue.
